‼️The U.S. Department of Justice has uncovered one of the largest marriage fraud cases in U.S. history. More than 1,000 sham marriages were arranged, and some foreign nationals paid as much as $100,000 to take part in the scheme.

⚠️When someone applies for a green card through marriage, USCIS must determine that the relationship is genuine and that the marriage was entered into in good faith – not solely for an immigration benefit.
⠀
⚠️If it’s later discovered that the person was not actually eligible for permanent resident status when they received it, USCIS can begin rescission proceedings.
⠀
⚠️And even if the person has already become a U.S. citizen, the risk doesn’t necessarily go away. In certain circumstances, the Department of Justice can seek denaturalization in federal court if the citizenship was obtained unlawfully, through concealment of a material fact, or through willful misrepresentation.

‼️Once marriage fraud has been established, you can’t simply get divorced, later enter into a genuine marriage, and go through the same immigration process all over again. Marriage fraud result – a lifetime bar on approval of future visa applications.

✅That said, in certain circumstances, the law does provide for a waiver – for example, when the applicant has a U.S. citizen or permanent resident spouse or parent and can demonstrate extreme hardship.

❗️A U.S. citizen who knowingly participates in a sham marriage can also face criminal penalties – up to 5 years in prison and a fine of up to $250,000.
