Public Charge Bond: When might you have to pay a bond for a Green Card?

✅ Throughout my 18 years of practice as a U.S. immigration attorney, I have handled not only straightforward green card cases but also many hard ones. A major challenge and obstacle is often the risk that a green card applicant might become dependent on government assistance. To address such cases, U.S. immigration law provides for a “Public Charge Bond” (Form I-945). Although this mechanism was previously introduced and then rescinded, it has been active and actively used since September 2026 to overcome potential “public charge” issues.

❗️ This is not a mandatory payment for everyone obtaining a green card, and not a guaranteed way to avoid a denial.

✔️ USCIS decides on its own whether to offer an applicant the option to pay a Public Charge Bond and determines the amount. Form I-945 can only be processed after receiving official notification from USCIS, it cannot be filed proactively on one’s own initiative.

✅ The bond can be payed by the applicant, another individual, or an organization. Two options are available: a cash bond or a bond secured through an authorized surety company.

❗️ The amount is determined on a case-by-case basis. This is not a government filing fee for Form I-945, but a separate sum that must be fully payed.

❓ Can the bond be refunded? Yes, provided certain conditions are met. Grounds for a refund include the passage of five years after obtaining permanent resident status without violating the bond conditions.

✅ The bond may also be cancelled:

• obtaining U.S. citizenship
• permanently leaving the country
• the applicant’s death

✔️ Form I-356 is used to request cancellation.

⚠️ If bond conditions are violated, the posted funds may be forfeited.
