Deportation from the US

Removal proceedings, otherwise referred to as deportation is an administrative procedure of foreign citizens expulsion from the US. Deportation takes place in case of violation of immigration laws.

The three most common causes of deportation from the US

  1. Violation of immigration laws. Illegal immigrants, individuals who have overstayed their visas, asylum seekers who missed their asylum interview are subjects for deportation. 
  2. Denial of asylum. 
  3. Violation of the terms of the permanent residency (green card). 

Other reasons for deportation from the US:

  • Trade of narcotic substances;
  • Trade of arms;
  • Homicide and violence;
  • Loot;
  • Documents falsification fraud;
  • Other serious violations of the US criminal law
  • Benefits fraud;
  • Illegal voting;
  • Planning of terrorist attacks, connections to terrorist groups;
  • Espionage;
  • Illegal import of goods or import of illegal goods.

Deportation process – step by step:

  1. Subpoena to the immigration court stating the offenses. Individuals who are deemed dangerous may be detained. 
  2. Court hearing. Representation of an immigration lawyer at this stage is a must. The lawyer will develop a defence strategy to avoid deportation. 
  3. Decision of the judge.
  4. If deportation is approved by the judge, the lawyer can file an appeal. If the appeal is unsuccessful, the lawyer can file another appeal to the federal court.
