Citizens of Ukraine with a parole or arriving by the U4U program can extend their right to stay in the United States for 2 years.
Who is eligible:
- Ukrainians who received a parole at US border from February 11 to April 25, 2022
- Ukrainians who are in the USA by the Uniting for Ukraine (U4U) program
From February 27, 2024, the above-mentioned Ukrainian citizens and their immediate family members have the right to apply for a re-parole, which will allow them to stay legally in the USA for another 2 years.
How to apply for a re-parole:
- Complete Form I-131 (can be completed online in your USCIS account or submitted on paper to USCIS by mail)
- Along with Form I-131 (online or by mail), you must also submit:
– Form I-94 (document confirming entry into the USA)
– copy of work permit (EAD)
– a copy of your driver’s license or other ID with photo
– a copy of the first page of the passport and all pages containing stamps related to entry/exit into and out of the USA
- Pay a registration fee of $575 per person. (If you are eligible for an application fee waiver, please submit a paper form. You cannot request this waiver if you complete the form online.)
If you send any document to USCIS that is not in English, you must attach a complete notarized translation into English.
You can apply for re-parole 90 days before your parole expires.
How Ukrainians can correctly fill out Form I-131 for re-parole:
- In the form select the “I am outside the United States, and I am applying for an Advance Parole Document” option, even if you are now in the United States.
- Check “Yes” next to the question asking whether you are applying for a re-parole.
- If you are filling out the form for a minor, please include his/her name as the applicant (you do not need to provide your details).
- When mailing a paper form, be sure to handwrite “Ukraine RE-PAROLE” at the top of the document.
What requirements must a citizen of Ukraine meet to receive a re-parole:
- be a citizen of Ukraine or a close relative of a citizen of Ukraine who received a parole when crossing the US border no earlier than February 11, 2022 or came to the US by the U4U program
- have serious reasons for renewing your parole
- have a positive moral character (it can be spoiled, for example, by fines for violating traffic rules or legal proceedings)
- be physically located in the USA
- fulfill all conditions of the initial parole
- pass a background and biometric check.
USCIS will make decisions about re-parole for each applicant individually.
