Notice to Appear Rules changed: more aliens may now be deported from the USA

USCIS has changed the rules for issuing Notice to Appear (NTA) for aliens who may be deported from the United States.

Receiving an NTA means that deportation proceedings against you have already begun. In this situation you can not leave the country while your deportation case is pending. Departing before a final decision is made could result in a 10-year ban on re-entry.

Under the new rules, USCIS will issue NTA in the following cases:

✔️ If a conditional green card has expired and a petition to remove conditions has not been filed

✔️ If refugee status has been revoked

✔️ If fraud or misrepresentation is discovered in your immigration case

✔️ Denial of Forms I-751 and I-829

✔️ If the individual is suspected of terrorism or espionage

✔️ If the individual has committed criminal offenses in the U.S. and has been arrested or convicted

✔️ If Temporary Protected Status (TPS) has been revoked and the individual has no other lawful immigration status (if an entire country’s TPS designation is terminated, all former beneficiaries without another legal status will be deported)

✔️ If a naturalization application (U.S. citizenship) has been denied

✔️ An NTA may now be issued even for minor filing errors, such as incorrect form completion or insufficient payment of filing fees

USCIS will primarily issue NTAs to those who have violated U.S. immigration laws and who have committed crimes in the United States.
